1. Introduction
Welcome to Shibspot (“we”, “us”, “our”, or the “Platform”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile applications, and marketplace services (collectively, the “Services”).
By accessing, browsing, or using the Services, you (“User”, “you”) agree to be legally bound by these Terms. If you do not agree, you must not use the Services.
2. Nature of Our Service
Shibspot is a marketplace platform that enables independent sellers in Japan (“Sellers”) to list, advertise, and sell products to buyers worldwide (“Buyers”). Unless explicitly stated otherwise:
- We are not the seller of items listed by independent sellers.
- Contracts for the purchase of goods are formed directly between Buyers and Sellers.
- We do not own or control the products listed on the Platform.
We provide payment processing, customer support, and dispute resolution assistance, but we are not a party to the transaction between Buyer and Seller.
3. Eligibility
To use the Services, you represent and warrant that:
- You are at least 18 years old (or the age of legal majority in your jurisdiction).
- You have legal capacity to enter into a binding contract.
- You are not prohibited from receiving services under applicable laws.
4. Account Registration
You may browse the Platform without registering, but certain features require an account.
You agree to:
- Provide accurate information;
- Keep your login credentials confidential;
- Be responsible for all activities under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.
5. Marketplace Transactions
When a Buyer purchases an item:
- The Seller is responsible for product availability, description, pricing, shipping, warranties, and returns (as applicable).
- The Buyer is responsible for ensuring accurate shipping information and timely payment.
We may facilitate payment collection on behalf of Sellers, but we do not assume title to goods and do not provide warranties regarding product quality, authenticity, condition, or safety beyond what is required by law.
6. Payments and Fees
Payments are processed through approved third-party payment providers. Buyers are responsible for:
- Purchase price
- Shipping fees
- Customs duties, import taxes, or other charges (if applicable)
Refunds are handled in accordance with the Returns & Refund Policy. Sellers may be charged platform fees, which are described in the Seller Terms.

In the event of any inconsistency between those policies and these Terms, these Terms will prevail.
8. User Responsibilities
Users agree not to:
- Violate any laws or third-party rights;
- Post inaccurate, fraudulent, or misleading content;
- Attempt unauthorized access or interfere with Platform operations;
- Use the Platform to buy/sell prohibited items (see Prohibited Items Policy);
- Harm the reputation of the Platform, its users, or partners.
9. Intellectual Property
All content provided by us—including logos, trademarks, text, images, and software—is the property of Shibspot or its licensors and may not be used without permission.
Users may not upload or sell products that infringe the intellectual property rights of others. For copyright complaints or takedown actions, please refer to our IP / DMCA Policy.
10. Dispute Resolution
Most buyer–seller issues should first be resolved via our customer support system.
If a resolution cannot be reached:
- Buyers may have access to the dispute process outlined in the Returns & Refund Policy.
- Sellers are bound by the escalation framework in the Seller Terms.
Nothing in these Terms limits consumer rights granted under applicable laws.
11. Suspension and Termination
We reserve the right to suspend or terminate accounts without notice if:
- These Terms are violated;
- Fraudulent or illegal activities are suspected;
- Required by law or regulatory authorities.
12. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for losses arising from transactions between Buyers and Sellers.
- We do not guarantee product accuracy, authenticity, or safety.
- We are not responsible for shipping delays, customs inspection, or lost parcels unless directly caused by our negligence.
Some jurisdictions do not allow exclusions of warranties—rights vary by location.
13. Governing Law
These Terms are governed by the laws of Japan, without regard to conflict-of-law provisions. Disputes shall be subject to the exclusive jurisdiction of the courts of Japan, unless otherwise required by consumer protection laws.
14. Amendments
We may update these Terms from time to time. The “Last Updated” date will always be posted at the top of this page. Continued use of the Platform after changes indicates acceptance of the revised Terms.
